Smith & Wesson fires a shot at Cybergun

More and more airsoft news and information sites are getting on the case of Cybergun. Everything Airsoft posted news a few days ago that Smith & Wesson has filed a lawsuit against Cybergun in the District of Arizona for trademark infringements and Unfair competition. We all know that Cybergun has bought the rights to license S&W trademarks in the airsoft market.

Everything Airsoft has already dug into the court documents filed by S&W, which they say:

In February 2009, Smith and Wesson allegedly notified Cybergun SA that third party retailer Palco Sports, a distributor for licensed Cybergun products, was allegedly using and displaying Smith & Wesson ‘Marks’ in it’s 2009 catalogue without express permission and approval from Smith & Wesson and that subsequently, Cybergun was in breach of their license agreement.



Furthermore, due to this breach of contract, S&W has terminated the agreement, which means that Cybergun has lost control of licencing the former's trademarks to airsoft manufacturers.

This means that even with the ongoing lawsuit, future licensing agreements for using S&W trademarks is now very much open. Either another company specializing in trademark licensing will try to get an agreement, or airsoft manufacturers must make the beeline to the office of Smith & Wesson. For airsoft players, a direct agreeement would sound a better deal, since it cuts off the cost of having a middle person, lowering the pricing for airsoft guns that bear the S&W trademarks.
